Organizational-use Disclaimer

1. Purpose of this disclaimer
BrainEng is designed to help a team and its leadership see and act on a system condition, not to evaluate individual people. This page sets out the commitments an organization makes when it uses the Service, and is presented to every account holder at registration.
2. Prohibited uses
By using BrainEng, an organization agrees that it will not:
- Use diagnostic results, individually or in aggregate, as the basis for hiring, promotion, compensation, or termination decisions about a specific person;
- Attempt to identify how a specific individual responded to any item;
- Use the Service, or require its use, in a way that functions as covert monitoring of employees;
- Represent Binding Constraint results, or the Team Flow Propensity construct, as validated performance measures or predictors to employees, boards, or regulators;
- Bypass or attempt to lower the five-participant reporting threshold to view smaller-group or individual results.
3. Intended use
Results are intended to inform a team-level conversation about which system condition to engineer against next, and to structure a bounded six-week experiment. Any subsequent management action remains the organization's own decision and responsibility, made through its normal processes.
4. Employee communication
We recommend organizations tell participants, in plain language, what the diagnostic is for, that responses are aggregated and never shown individually to a leader, and that no disciplinary action will be taken based on results.
5. Organization responsibility
The organization administering an account is responsible for compliance with its own employment, labor, and works-council obligations in the jurisdictions where it operates. BrainEng's role is limited to providing the diagnostic instrument and platform under these terms.
6. Changes to this Disclaimer
We may update this Disclaimer over time; material changes will be reflected in the version date above.
