Terms of Service

1. Agreement

These Terms govern access to and use of the Brainload Engineering platform ("BrainEng", "the Service") operated by Brainload Engineering. By creating an account or using the Service, you agree to these Terms on behalf of yourself and, where applicable, the organization you represent.

2. The Service

BrainEng provides a structured diagnostic across nine system conditions, aggregate reporting for teams, and tooling to design and track six-week engineering experiments. The Service does not provide medical, psychological, legal, or employment-law advice, and its outputs must not be used as the sole basis for personnel decisions.

3. Accounts and eligibility

You must provide accurate registration information and are responsible for activity under your account. Accounts are intended for use by authorized representatives of an organization, acting within the scope of that organization's use of the Service.

4. Acceptable use

You will not use the Service to identify, rank, or discipline individual employees; to circumvent the participation thresholds and privacy protections built into the diagnostic; or to attempt to re-identify individual responses from aggregate reports.

5. Subscriptions and billing

Paid plans are billed monthly or annually as selected at checkout, per the pricing published on the Service. Annual billing is charged at a reduced total equivalent to two free months compared to monthly billing. Fees are non-refundable except as required by law or expressly stated at the time of purchase.

6. Data ownership

As between you and BrainEng, your organization retains ownership of the data it submits. BrainEng retains ownership of the diagnostic instrument, scoring methodology, and the platform itself.

7. Disclaimers

The Service, including the diagnostic instrument, is provided without guarantee of any particular business outcome, including any specific recovery of capacity or resolution of a binding constraint within any timeframe. 8. Limitation of liability

To the maximum extent permitted by law, Brainload Engineering will not be liable for indirect, incidental, or consequential damages arising from use of the Service.

9. Termination

Either party may terminate an account subscription in accordance with the billing terms presented at signup. We may suspend accounts that violate acceptable use or that put other tenants' data at risk.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected in the version date above, and continued use of the Service after an update constitutes acceptance of the revised Terms.
